Participant terms: registration, tickets, admission

These terms apply to attendees of events organized through the AirLST platform: contract with the organizer, prices and payment, withdrawal and cancellation, tickets and admission, data protection. English translation for convenience; the German version prevails.

1Scope, role of AirLST, age of majority

1.1

These terms apply to all registrations, ticket purchases and bookings (“Bookings”) made via the technical platform and associated systems provided by AirLST GmbH, Seitzstraße 23, 80538 Munich, Germany (“AirLST”).

1.2

AirLST is not the organizer. The contract for participation in an event is concluded exclusively between the organizer named in the offer (“Organizer”) and the person booking/participant (“Participant”). AirLST exclusively provides the technical infrastructure for registration, ticketing and payment processing.

1.3

Age of majority: Our offer is directed exclusively at persons of legal age. By making a Booking, the Participant confirms that they are of legal age.

1.4

In addition to these terms, participant terms and conditions of the Organizer may apply. In the event of conflicts between these terms and the Organizer’s terms, these participant terms take precedence insofar as they concern the use of the booking platform.

1.5

Incorporation of the Organizer’s terms: AirLST provides technical functions that allow the Organizer to store its own participant terms and conditions and data protection information and to have them displayed in the ordering process. The Organizer bears sole responsibility for the content, completeness and legal validity of these terms. AirLST does not review these texts. These terms are incorporated into the contractual relationship with the Participant exclusively by the Organizer.

2Subject matter and conclusion of contract

2.1

Content, prices, taxes, cancellation/refund rules and mandatory information about the event are provided solely by the Organizer; AirLST has no influence on these.

2.2

With the event offer, the Organizer makes an offer to enter into a contract. The Participant accepts this offer by clicking the order/buy button provided in the order form, after all mandatory fields have been completed and (i) these participant terms and (ii) the Organizer’s terms, if any, have been accepted.

2.3

After conclusion of the contract, the Participant promptly receives a confirmation email at the email address provided. If the Participant does not receive a confirmation, they must inform the Organizer. Depending on the Organizer’s settings, a link to a booking portal may also be provided, through which the Booking can be viewed.

2.4

Booking for third parties: Anyone who purchases tickets for third parties or registers third parties confirms that they have (a) informed the person concerned of these participant terms and, where applicable, the Organizer’s terms and bound them to these terms, and (b) fulfilled the information obligations under data protection law towards the third party and obtained any required consent.

3Prices, taxes, payment and due date

3.1

Prices/taxes: The Organizer sets all prices and controls whether they are displayed including or excluding VAT. The corresponding information is displayed transparently in the booking process.

3.2

Payment processing: Paid Bookings are processed via connected payment service providers (e.g. Mollie, Stripe, PayPal). By selecting the payment method, the Participant grants the respective payment mandate to the PSP. AirLST is not a payment service provider within the meaning of the ZAG (German Payment Services Supervision Act).

3.3

Invoice/payment confirmation: For paid Bookings, the Organizer issues the invoice. After receipt of payment, the Participant receives a payment confirmation by email (depending on the process); it may also be viewable via the booking portal.

3.4

Payment terms: Invoice amounts are due without deduction in a single payment; partial or installment payments are not permitted. Subsequent changes to the payment method are excluded.

3.5

Bank transfer (if offered): When paying by bank transfer, the booking number must be stated in the payment reference. The Booking is only deemed complete once payment has been received in full; until then, the place is only reserved. The amount must be transferred promptly and must be received no later than two business days before the start of the event. If payment is not received in time, the Organizer may cancel the Booking; any claim to participation lapses. Fees and currency differences for international transfers are borne by the Participant.

3.6

Late payment: If a set payment date is not met, the Organizer may, after giving notice, cancel the Booking. AirLST is not liable for costs incurred by the Participant as a result of late payment or cancellation due to non-payment.

4Withdrawal, cancellation, exchange and event changes

4.1

Withdrawal: Informing the Participant about any statutory right of withdrawal and handling such withdrawal are the sole responsibility of the Organizer (the Participant’s contracting party). Without guarantee, please note that for events tied to a specific date or period, there is often no statutory right of withdrawal (Section 312g (2) No. 9 BGB, German Civil Code).

4.2

Cancellation/postponement/program changes: The Participant’s rights and claims in these cases are governed by law and the Organizer’s rules. Any reversal of the transaction is handled directly with the Organizer.

4.3

Contact: The Organizer’s contact details can be found in the event offer and in the booking confirmation; otherwise, they can be requested via the booking-related communication channels.

5Tickets, admission, transfer

5.1

Tickets may be personalized; the Organizer’s requirements are decisive.

5.2

Unauthorized transfer or resale of tickets is prohibited. The Organizer may block tickets in the event of misuse.

6Obligations of the Participant, use of the platform

6.1

The Participant provides accurate information and updates it if it changes.

6.2

The platform may only be used as intended and lawfully; in particular, circumventing access restrictions, entering inaccurate data and unlawful content are prohibited.

6.3

Where an account is used, access credentials must be kept confidential.

7Liability of AirLST

7.1

AirLST is liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulent concealment and in cases of mandatory liability (e.g. under the ProdHaftG, German Product Liability Act).

7.2

In the case of simple negligence, AirLST is only liable for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract; indirect damage and lost profits are excluded.

7.3

The Organizer is solely liable for event content, execution, quality, cancellation or postponement.

7.4

AirLST is not liable for disruptions outside its sphere of influence (e.g. internet outages, browser incompatibilities, disruptions at payment providers).

7.5

Limitation period: Claims for damages against AirLST (except in the cases of clause 7.1) become time-barred one year after they arise.

8Data protection

8.1

The controller within the meaning of the GDPR for the processing of participant data in connection with the event is the Organizer.

8.2

AirLST processes personal data as a processor on behalf of the Organizer in accordance with Art. 28 GDPR. For payment data, the terms of the respective payment service provider apply in addition.

8.3

Further information is contained in the data protection information of the Organizer and of AirLST.

9Changes to these participant terms

9.1

AirLST may amend these participant terms with effect for the future. The currently valid version is available on the booking platform. In the event of material changes, AirLST will provide information as part of the booking process or via the information channels provided.

10Communication, final provisions

10.1

Declarations may be made by email or by mail. AirLST may send declarations to the Participant’s email address provided in the booking process.

10.2

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Insofar as permissible, the place of jurisdiction is Munich.

10.3

Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected; in place of the invalid provision, a provision that comes closest to the economic purpose shall apply.
