1.1
These Participant Terms apply to all registrations, ticket purchases and bookings (“Bookings”) made through the technical platform provided by AirLST GmbH, Seitzstraße 23, 80538 Munich (“AirLST”).
1.2
AirLST is not the organiser of the event. The contract for attending an event is concluded exclusively between the organiser named in the event information (“Organiser”) and the participant (“Participant”). AirLST merely provides the technical infrastructure for registration, ticketing and payment processing.
1.3
Age requirement: The service is intended for adults only. By completing a booking, the Participant confirms that they are at least 18 years old.
1.4
In addition to these terms, the Organiser’s own participant terms or booking conditions may apply. In the event of discrepancies, these AirLST Participant Terms take precedence to the extent they concern the use of the booking platform.
1.5
AirLST provides technical functionality for Organisers to upload their own participant terms and privacy notices. The Organiser remains solely responsible for the content, accuracy and legal effectiveness of those documents. AirLST does not review or validate such texts. Incorporation of these terms into the contract with the Participant occurs exclusively through the Organiser.
2.1
All event information (including prices, taxes, refund rules, programme details and mandatory disclosures) is provided solely by the Organiser. AirLST has no influence or responsibility in this respect.
2.2
By publishing the event information, the Organiser makes a binding offer. The Participant accepts this offer by clicking the order/purchase button in the checkout, after completing all required fields and accepting (i) these Participant Terms and (ii) the Organiser’s terms, if applicable.
2.3
After completion of the booking, the Participant receives a confirmation email. If no confirmation is received, the Participant must notify the Organiser. Depending on the Organiser’s settings, a booking portal link may also be provided.
2.4
Booking on behalf of third parties: Anyone purchasing tickets or registering other individuals confirms that (a) the third party has been informed of and agrees to these Participant Terms and any Organiser terms, (b) all data protection obligations towards the third party have been fulfilled and any required consents obtained.
3.1
Pricing and tax presentation are controlled solely by the Organiser. The applicable price (including or excluding VAT) is displayed transparently during checkout.
3.2
Payments for paid bookings are processed via third-party Payment Service Providers (PSPs), such as Mollie, Stripe or PayPal. By selecting a payment method, the Participant authorises the PSP to execute the payment. AirLST is not a payment service provider within the meaning of the German ZAG.
3.3
Invoicing/payment confirmation: For paid bookings, the Organiser issues the invoice. Upon successful payment, a confirmation email will be sent; booking details may also be accessible through the booking portal, where enabled.
3.4
Payments are due in full and in a single transaction. Partial or instalment payments are not permitted. After completion of the booking, the payment method cannot be changed.
3.5
Bank transfer (if offered): The booking reference must be included in the payment reference. A booking is not considered complete until full payment is received; until then, the place is only reserved. Payment must be made promptly and no later than two business days before the event. If payment is not received in time, the Organiser may cancel the booking. Fees or exchange rate differences for international transfers are borne by the Participant.
3.6
If a payment deadline is missed, the Organiser may cancel the booking after notifying the Participant. AirLST is not liable for any costs arising from delayed payment or related cancellation.
4.1
Withdrawal rights: The Organiser is solely responsible for providing statutory withdrawal information and handling any withdrawal requests. Without warranty, note that no statutory withdrawal right typically applies to events with a fixed date or period (§ 312g (2) No. 9 BGB).
4.2
Event cancellation, postponement or programme changes: Rights and claims arising from such changes are governed by the Organiser’s terms and applicable law. Refunds or exchanges are handled directly between the Participant and the Organiser.
4.3
Contact details of the Organiser are listed in the event description and booking confirmation; otherwise accessible via the booking-related communication channels.
5.1
Tickets may be personal or non-transferable, depending on the Organiser’s configuration.
5.2
Unauthorised resale, transfer or duplication of tickets is prohibited. The Organiser may block or invalidate tickets in case of misuse.
6.1
Participants must provide accurate data and update their information when required.
6.2
The Platform may only be used lawfully and as intended. Any attempt to bypass access restrictions, provide false information or upload unlawful content is prohibited.
6.3
If an account is used, login credentials must be kept confidential.
7.1
AirLST is liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, for fraudulent concealment and in cases of mandatory liability (e.g., product liability law).
7.2
For simple negligence, AirLST is liable only for breaches of essential contractual obligations (cardinal duties), limited to the foreseeable, typical damage. Indirect damages and lost profits are excluded.
7.3
AirLST is not liable for event content, execution, quality, postponement or cancellation. These are the sole responsibility of the Organiser.
7.4
AirLST is not liable for disruptions outside its control (e.g., internet outages, browser incompatibilities, PSP outages).
7.5
Claims for damages (except those under clause 7.1) expire one year after they arise.
8.1
The Organiser is the controller under the GDPR for processing Participant data in connection with the event.
8.2
AirLST processes personal data exclusively as a processor on behalf of the Organiser pursuant to Art. 28 GDPR. Payment data is additionally subject to the terms of the relevant PSP.
8.3
Further information is provided in the Organiser’s and AirLST’s privacy notices.
9.1
AirLST may amend these Participant Terms with effect for the future. The current version is available on the booking platform. Material changes will be highlighted during the booking flow or via designated information channels.
10.1
Communications may be sent via email or post. AirLST may contact the Participant at the email address provided during the booking.
10.2
German law applies, excluding the UN Sales Convention. Where legally permissible, the courts of Munich shall have jurisdiction.
10.3
If any provision is or becomes invalid, the remaining terms remain unaffected. The invalid provision shall be replaced by one that most closely reflects the intended economic purpose.
